ACCESSING THE SITE INDICATES THAT YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THIS SITE. THESE TERMS OF USE ARE ISSUED BY AJC PUPS N STUFF.

1. Introduction

1.1 By accessing any part of the Site, you shall be deemed to have accepted these Terms in full. If you do not accept these Terms in full, you must cease to use the Site immediately.

1.2 AJC PUPS N STUFF may amend or revise these Terms at any time without notice. The amended Terms and Conditions will be effective immediately and you will be bound by the amended Terms and Conditions from that time. It is your responsibility to check this page to review any revised terms.

2. Registration

2.1 To submit a photo and enter a competition, you must complete the entry form agreeing to the terms and conditions. The information you provide about yourself must be true, accurate, current and complete (such information being the "Registration Data"). In particular this includes but is not limited to your confirmation either that you are over the age of 18 or that you are the parent or guardian of a person under 18 acting on that person's behalf and confirming agreement to be a contributor in accordance with these Terms. It is also your responsibility to update the Registration Data promptly to maintain its accuracy. If you provide any information that is untrue, inaccurate, not current or incomplete, AJC PUPS N STUFF has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). AJC PUPS N STUFF is concerned about the safety and privacy of all its users, particularly all minors (anyone under the age of 18). If you are a parent or guardian of a child of any age, it is your responsibility to determine whether any of the Services and/or content on the Site are appropriate for your child.

3. Intellectual Property - License and License-Back and Terms

3.1 You must own (copyright and otherwise) the rights to any image or photo posted on this site. By posting a photo you are confirming your ownership of said rights. You may not enter a photo to the Site that you did not create or that you do not have permission to post.
3.2 You understand and agree that the AJC PUPS N STUFF may, but is not obligated to, review any photo and may delete or remove (without notice) any submission in its sole discretion, for any reason or no reason, including a photo that in the sole judgment of the site violates this agreement or the other policies posted on this site (i.e., AJC PUPS N STUFF's Privacy Policy), or which might be offensive, illegal, or that might violate the copyright or other rights, harm, or threaten the safety of users or others.
3.3 You are solely responsible at your sole cost and expense for creating backup copies and replacing any photo you post or store on the Site or provide to AJC PUPS N STUFF.

3.4 By accepting these terms and in consideration of your registration and use of the Site you hereby grant AJC PUPS N STUFF an exclusive and worldwide license to use all photographs uploaded to the site in all media for the full period of the copyright and any similar rights.

3.5 AJC PUPS N STUFF hereby grants you a non-exclusive license to use the photographs for private and domestic purposes. If you wish to use the photographs commercially, please contact us and we will consider an extension of this license-back in this regard.

3.6 Unless otherwise stated, the copyright and all other intellectual property rights in all countries in all materials on this Site (including without limitation photographs and graphical images) are owned by AJC PUPS N STUFF or its licensors. Any use of extracts from this Site for any purpose is strictly prohibited.

3.7 No part of this Site may be reproduced or stored on any other website or included in any public or private retrieval system or service without AJC PUPS N STUFF's prior written permission.

3.8 Any rights not expressly addressed in these Terms are reserved.

4. Service Access / Technical Malfunction

4.1 While AJC PUPS N STUFF endeavors to ensure that the Site is normally available 24 hours a day, AJC PUPS N STUFF will not be liable if for any reason the Site is unavailable at any time or for any period including but not limited to technical failure.

4.2 Access to the Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond AJC PUPS N STUFF's control.

5.3 You acknowledge that you are solely responsible for the content of your submissions and you agree to submit only contributions that are your own original work, such contributions must be accurate (where they state facts) and genuinely held (where they state opinions).

5.4 You are prohibited from submitting to the Site any material which:
(a) is unlawful, harassing, threatening, defamatory, harmful, profane, indecent, pornographic, vulgar, obscene, abusive, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
(b) violates a patent, trade mark, copyright, trade secret or other intellectual property rights of others or for which you have not obtained all necessary licenses and/or approvals;
(c) constitutes or encourages conduct that would be considered a criminal offense, give rise to civil liability, or otherwise be contrary to the law or infringe the rights of any third party, in the US or any other country in the world;
(d) constitutes any form of marketing or advertising; or
(e) is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

Votes cast should reflect the voter's honest assessment of each photo; voters must not cast their votes in order to manipulate contest results. This includes, but is not limited to, voting on any entry more than once. Votes cast in this manner will disqualify any such user's entry. Voting patterns on AJC PUPS N STUFF are actively monitored to detect irregularities. This includes, but is not limited to multiple votes for a specific photo and disingenuous or malicious casting of low votes. If AJC PUPS N STUFF detects any such usage, it reserves the right, at its sole discretion to nullify related votes, disqualify and/or remove photo entries and/or disqualify entrants from any further participation on the AJC PUPS N STUFF site. In order to preserve the integrity of the site, we take these issues very seriously.

5.6 Violation of this section may lead to legal action being taken against you by the authorities or an aggrieved third party.

6. Contribution Rules

6.1 Where you submit a contribution to the Site, you must do so in accordance with these Terms, in particular section 5, and the following Rules:
(a) you acknowledge that you are solely responsible for the content of your submissions and you agree to submit contributions that are civil and tasteful;
(b) you agree to keep your number of contributions to a reasonable level to enable AJC PUPS N STUFF to publish contributions from as many different people as possible;

6.2 AJC PUPS N STUFF reserves the right at all times, without case and without notice, whether or not you are in breach of these Terms, to:

(a) edit, refuse to post or remove any material in whole, or in part;
(b) to suspend your access to this Site.
AJC PUPS N STUFF's decision in these matters shall be final.

11. Copyright Matters

11.1 We respect the intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the Site any materials that violate another party's intellectual property rights. When we receive proper Notification of Alleged Copyright Infringement as described below, we promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers as described herein in accordance with the Digital Millenium Copyright Act. If you believe that any material on the Site infringes upon any copyright which you own or control, you may send a written notification of such infringement to our Designated Agent.

12. Contest Winners

12.1 All decisions regarding the outcome of the Site's contest are subject to the sole discretion of the Site and are final beyond dispute, including but not limited to, the scoring and interpetation of the results.
12.2 Employees and their immediate families are not eligible to receive AJC PUPS N STUFF prizes.
12.3 Non-winning photos may be resubmitted into future contests, but winning entries are not eligible for future AJC PUPS N STUFF contests. No photo or single dog is eligible to win more than one contest in a specific year.
