The following is an agreement that we require new owners to sign before the purchase of one of our japanese chin puppies. As ethical and loving Japanese Chin breeders, we feel this is essential to the happiness and well-being of our animals. If you have any questions, please send us an email.

Japanese Chin Puppy Pet Agreement

This agreement is made and entered into this ______ day of _____ 2003 by and between Amaya's Japanese Chin Breeders (Seller), and _________________________________ (Buyer), for the purpose of setting forth the terms and conditions of purchase by the buyer of a purebred Japanese Chin (Puppy) from the litter whelped on ______ __, 2003.

The seller agrees to sell and buyer agrees to purchase one female/male japanese chin companion puppy from the litter described above subject to the following terms.

1. Seller warrants that the above described puppy is a purebred Japanese Chin registered with The American Kennel Club and that limited-registration papers have been provided to the buyer as of the date of the completed purchase, together with a copy of the puppy’s pedigree.
2. Seller warrants the puppy is in good health at the time of purchase. The buyer has 72 hours (excluding Sundays) from the time of purchase to have the puppy examined by a veterinarian as to soundness of health. If the veterinarian finds any major health problems, the cause that is clearly attributable to the breeder, the buyer may bring the puppy back to the seller, with a letter from the veterinarian explaining the problem found.
3. The seller must be contacted within the 72-hour period after purchase and notified of any problems, and the puppy must be returned within 96 hours of purchase. At this time the seller will, upon receipt of the puppy and all items given with the puppy (including the AKC papers to be signed back to the breeder) refund to the buyer the full purchased price of the puppy, by check or cash.
4. The puppy is guaranteed against hip dysplasia until his/her first birthday. If the puppy develops hip dysplasia to the severity that the puppy will be in pain, or unable to function, the puppy will be replaced with a puppy of equal quality, as available. The buyer must produce a x-ray of the puppy’s hips and a letter from the veterinarian describing the severity before the puppy will be replaced.
5. The puppy will be registered under AKC's non-breedable limited registration. This means no puppies produced by this puppy can be registered with AKC. The puppy must be spayed/neutered by the age of seven months and before a female has her first heat. The buyer reserves the right to bring the puppy back to the seller for “show” evaluation before he/she is spayed/neutered.
6. The seller is to be notified if the buyer moves, or if the buyer can not keep the puppy for any reason he/she agrees to return the puppy to the seller. At no time should the puppy be placed in any rescue organization, shelter, pound or any other such organization for any reason.
7. At no time should the puppy be sold, traded or given to any second party without the seller’s consent.
8. Buyer agrees that he/she is not acting as an agent in the purchase of the puppy and that buyer will not sell the puppy to any agent, pet store or mill.
9. Buyer agrees that the puppy will reside at the home of the buyer, will be provided with proper housing, not be chained or tethered, provided with a good quality diet, annual shots and exercise and supplements.
10. Ownership of the puppy will be transferred to the buyer for the sale price of $____ to be paid as follows: $100.00 deposit on execution of the Agreement with the balance of $____ to be paid on or before the puppy leaves the seller premises. If the balance is not paid by _____________, this Agreement shall be cancelled and the buyer forfeits the deposit given hereunder.
11. If buyer requests delivery, it shall be by airfreight, to a designated location. Buyer is responsible for cost of crate, insurance during shipment, and cost of freight charges. All costs will be paid prior to delivery.
12. Seller is not responsible for any veterinarian bills or other bills the owner may incur after the purchase of the puppy.

This Agreement is made and signed by both parties to insure the well being and protection of the puppy. If the buyer breaches any part of this Agreement, the puppy will be returned to the seller with no compensation to the buyer and the seller is released from any obligations under this Agreement.
